You have just spotted an apartment that ticks all the boxes. One decisive step remains: putting together a rental application that can convince the landlord or the agency in just a few minutes. The required documents are framed by law, but the way they are presented often makes the difference between an accepted application and one that is ignored.

Prohibited documents for rental: what a landlord cannot require

Before gathering your supporting documents, knowing the legal limits prevents you from transmitting sensitive data unnecessarily. Some documents are strictly prohibited from being requested, whether the landlord is an individual or an agency.

The Vitale card, a detailed bank statement, a criminal record extract, or a medical file can never be among the requirements. A landlord who requests any of these documents risks a fine of up to 3,000 euros for an individual, or 15,000 euros for a corporate entity.

Another point to remember: the CNIL specifies, in its note of October 10, 2025, that no financial proof should be required before the property visit. At this stage, only the identity, contact details, and search criteria of the candidate are relevant. If an agency conditions the visit on the submission of pay slips, you have the right to refuse.

A well-structured application is based on the categories authorized by the decree implementing the ALUR law: identity, residence, professional activity, resources. Nothing more. Composing a file for a real estate agency on Tandem Immobilier allows you to concretely visualize the complete list and its variations according to profiles.

Identity documents and proof of residence for a tenant application

The first category is the simplest, but also the one where errors most often block an application.

One valid identity document is sufficient: national identity card, passport, or residence permit with photo. A driver’s license is also accepted. The landlord is not allowed to request two.

For proof of residence, several options are acceptable:

  • The last three rent receipts, if you are already a tenant, prove both your current address and your payment regularity.
  • A housing certificate signed by the person hosting you, accompanied by a copy of their identity document, is suitable if you are hosted free of charge.
  • A home insurance certificate or the latest energy bill in your name serves as proof of residence for current homeowners.

Be sure to check the date: a proof of residence older than three months will often be dismissed outright.

Proof of income and professional situation according to your profile

This is where the application is most personalized. The documents vary significantly between an employee, a freelancer, and a student.

Employee on a permanent or fixed-term contract

The employment contract (or an employer’s certificate specifying the date of hire, position, and salary) forms the basis. It is accompanied by the last three pay slips and the latest tax notice.

In practice, many landlords apply the rule that income should represent at least three times the rent amount. This is not a legal obligation, but a habit linked to the criteria of unpaid rent insurance.

Self-employed or freelance professional

Without a pay slip, the latest tax notice carries even more weight. The last two accounting statements or an income certificate issued by an accountant strengthen the credibility of the application. A freelancer benefits from attaching proof of registration in the professional register (Kbis extract, registration with Urssaf) to attest to the sustainability of the activity.

Student or retiree

A student provides their student card or a school certificate. The income then mainly relies on that of the guarantor.

A retiree submits their latest tax notice and pension slips. The stability of income works in their favor: a well-presented retiree application is often viewed very positively.

Guarantor and alternatives: securing a fragile rental application

When your income alone is not sufficient, a guarantor reassures the landlord. The guarantor must provide the same categories of documents as the tenant: identity, residence, activity, income. The guarantee deed, often joint, must comply with precise formalities to be valid.

Do you not have a guarantor in your circle? Two alternatives deserve attention:

  • The Visale guarantee, offered by Action Logement, covers unpaid rents and replaces a physical guarantor. It is free for both the tenant and the landlord and is mainly aimed at those under 31 and mobile employees.
  • Private rental guarantees function like insurance taken out by the tenant. They involve a monthly cost but broaden access to housing for atypical profiles.
  • The bank guarantee, less common, involves blocking a sum in an account. It remains an option for candidates with substantial savings but irregular income.

Protecting personal data in a rental application

Submitting an application means entrusting sensitive information. Applying a watermark on each document sent (mentioning “rental application – [date]”) reduces the risk of fraudulent reuse. The CNIL recommends this practice.

DossierFacile, the free public service, allows you to create a verified application and share it via a secure link. The documents do not circulate in multiple attachments, which limits their dissemination.

On the landlord’s side, the CNIL estimates that a retention period of three months in active storage is adequate for the data of unsuccessful candidates. If you have not heard back after this period, you can request the deletion of your documents.

A complete application, compliant with legal categories and well-protected, remains the best lever to secure the desired accommodation. The rigor in preparing the documents is as important as the level of income displayed.
